Not many licensed restaurants know that their on-sale type 41 or type 47 license allow for off-sale privileges. Take this scenario, Bay Area counties including San Francisco, San Mateo, Alameda, Contra Costa, Marin, and Santa Clara are expected to go into orders of shelter. Which means restaurants will be limited to take-out and deliveries only. As you can imagine this puts a big strain on restaurants and to help alleviate this burden, we have dug into the California Alcohol Beverage Control Act. Unless there is a particular condition that was given by the Department of Alcoholic Beverage Control (ABC) back when you filed for your license, with a type 41 or 47 your business can practice off-sale privileges. This means you can still offer take out and customers can come in a grab a sealed bottle of wine or beer with their meal. Suprisingly this also includes deliveries– the business has to ensure the person or delivery service delivering the food and alcohol uses proper ID verification.
If you do find a need to close your restaurant or business for 7 or more days. You need to file a status change with ABC to surrender your license. You will need to read the instructions and fill out ABC form 231.
